Abstract:
According to the verse 50 of surah Maedah, Exalted Allah is the best legislator, and divine laws are the best laws. This superiority, in addition to the content includes the structure and process of the laws too. Therefore, the goal of this research is interpretive review of form and process of legislation of social laws of Jihad, Hajj and Riba in the Holy Quran, so that it could be to extract a model for legislating the social issues from the Quran. Access to this example is important from this point that it could be used in the fields of social exegesis, jurisprudence and legislation. This research which has been written by descriptive-analytical method, and its data have been gathered by library way, has been achieved to a model -by separating the verses to “origin of law” and “the branches” and as well the order of Revelation of the verses- that based on it, those verses before the main command, pave the way for accepting the law by mentioning the background of that law and culturizing for it and the verses after the basic of the command, step ahead by explaining the subsidiary laws, using the tool for giving glad tidings and warning, observing the flexibility and expressing the wisdom and the consequences of that law for completing and having the law influence on obligated people for divine tasks (Mokallafin).
