چکیده:
ایجاد نظم و مقررات برای نظارت بر فعالیت های دولت هادر فضای مـاوراء جـو نقـش حیـاتی دارد. در اواخر سال ١٩٦٠، فعالیت های فضایی از هیچ ارزش نظامی برخوردار نبود، اما امروزه ، حداقل ٧٥ درصد از اشیاء پرتاب شده به فضا با هدف تامین نیازمندیهـای بخـش نظـامی انجـام مـی گیـرد. بـدون شـک ، فعالیت نظامی در فضا احتمال بروز جنگ را افزایش می دهد. در چند دهه اخیر، برخی کشورها، نظـامی سازی فضا و به تبع آن استفاده از تسلیحات فضاپایه را به عنوان بخشی از استراتژی امنیت ملـی خـود در اولویت قرار دادهاند که این روند موجبات تهدید و نقض صلح و امنیت را فراهم مـی سـازد. هنجارهـای حقوقی موجود نتوانسته از استقرار و کاربرد تسلیحات فضاپایه غیرمتعارف جلوگیری نماید. هدف اصلی این تحقیق پاسخ به این سوالات است که تسلیحات فضایی از منظر حقـوق بـین الملـل از چـه جایگـاه و ویژگی برخوردارند؟ آیا استفاده از تسلیحات فضاپایه تدافعی و متعارف توجیه پذیر است ؟ آیـا کـاربرد تسلیحات فضاپایه اصل «استفاده صلح آمیز» را نقض نمی کند؟ قواعد حقوق بین الملل موجود از ضمانت اجرایی کافی برای خلع سلاح در فضا برخوردار می باشد؟ نتایج تحقیق نشـان مـی دهـد کـه هنجارهـای حقوقی موجود برای ایجاد ممنوعیت تسلیحات فضاپایه ، نیازمند بازنگری و اصلاح می باشد.
Setting down rules and regulations has vital role in supervision the government's space military activities on outer space. In the end of 1960s, space activities hadnt any military value. However nowadays, at least 75% of space objects in order to eliminate military needs launch into space. There is no place for doubt that space military activities increase coming wars. In recent decades, some countries have begun militarization of outer space to advance their national security strategy as a priority. Nevertheless, this trend will threat international peace and security. Existing legal norms failed to provide supervision upon placement and application of unconventional space weapons. The main objective of present research is to answer the following questions: What are characteristics and position of space weapons in viewpoint of international law? Are utilizing the conventional or defensive spacebased weapons justified? Does space- based weapons application not breach the so-called principle "peaceful uses of outer space"? Do existing international law rules suffice for enforcement of outer space disarmament? The results of present research show that the legal norms for limitation of space- based weapons require revision and evolution.
