چکیده:
امروزه در راستای افزایش سرعت در تعقیب جرایم، مقنن با پذیرش جایگاهی برای آحاد جامعه، سازمانهای مردمنهاد، سازمانهای دولتی و کارکنان آنها سعی نموده است در جهت مقابله با بی کیفرمانی بزهکاران و افزایش حمایت از برخی بزه دیدگان تلاش نماید. به همین منظور، پذیرش جایگاهی برای عملکرد سازمانهای مردمنهاد در ماده 66 ق.ا.د.ک 1392(اصلاحی 1394) خود با پررنگ شدن اعلام جرم در دادرسیهای کیفری و لزوم تحلیل حقوقی آن همراه بود. ازیکطرف اعلام جرم در مقایسه با مفاهیمی چون شکایت از جرم و گزارش جرم اشتراکاتی دارد که به نحو شایسته موضوع تفکیک قانونگذار قرار نگرفته است، از طرفی نیز پیشبینی تقنینی اعلام جرم در قالب مصادیقی چون شخصیت اعلامکننده جرم، جرمِ موضوع اعلام و اینکه کدام مقام صلاحیتدار دریافت نهایی اعلام جرم تلقی میگردد نیازمند بازشناسی جامع است. درنهایت نیز شرایطی که میبایست در قوانین بهمنظور افزایش اثربخشی اعلام جرم پیشبینی گردند، از شیوه اعلام جرم تا ضمانت اجراهای ناظر به عدم اعلام جرم، اعلام جرم توأم با سوءنیت و نیز اعلام جرم غیراصولی مباحث مهمی هستند که فقدان تحلیلها در آنها کامل مشهود است. در همین راستا، به نظر میرسد که لزوم پیش بینی ضابطه مند و دقیق اعلام جرم در تفکیک از گزارش جرم و نیز اشاره به ضمانت اجراهای عدم تعقیب مسبوق به اعلام های جامعوی می تواند به رویه های قضایی جهتی اثربخش بدهد.

Finally, the conditions that should be envisaged in the laws to increase the effectiveness of the declaration of crime are from the method of announcing a crime to guaranteeing non-proclaimed performances, declaring a crime with maladministration, as well as declaring a non-principled crime as important issues as the lack of The analyzes are perfect in them. In the same vein, it seems that the need for a precise and accurate prediction of a crime to be distinguished from a crime report, as well as a reference to the guarantee of non-prosecution actions for public statements, can provide effective judicial procedures.
