چکیده:
توصلت هذه الدراسة إلى أن القضاء في الإسلام مر بمراحل تاريخية تطورت وفقا للظروف السياسية والاجتماعية التي عاشتها الخلافة الإسلاميةء بدءا من عهد الرسول #8. التي امتازت بالبساطة نتيجة لبساطة المجتمع الإسلاميء وعدم تعقيد الحياة الاجتماعية والسياسية وحتى الثقافيةء وعلى الرغم من بساطة ذلك العهدء إلا أننا نرى أن النبي وا خلفاء من بعده كانوا حريصين على تطبيق العدالة الاجتماعية والدينية. بالإضافة إلى تقديم اللشورة والوصايا لإقامة العدل والإنصافء ومع أن القضاء في الدولة الأموية اتبع نفس النهج الذي اتبعه القضاء في العهد الراشدي, إلا أن الخلفاء مثل عبد الملك بن مروان وعمر بن العزیز فهموا مدی تعقيد الحياةء لذا أعطوا القضاء أهمية كبيرة مثلة في ظهور عدد من المحاكم الملتخصصة في المظالم والحسبة والشرطةء لكنهم كرسوا وقتا معينا للنظر في المظالم.
The study found that the

gave the judiciary great importance
represented in the emergence of the
