چکیده:
مما لاشك فيك أن أحد مزايا فقه الإمامية
هو التصنيف الموضوعي للأبحاث وعرض
قواعد لترتيب الأحكام الشرعية. منذ فترة
طويلة سعى الفقهاء إلى استنباط أحكام جزئية
من خلال جمع هذه القواعد الفقهية العامة.
أحد القواعد التي تم التحدث بها واستخدامها
في مختلف الأبواب الفقهية مثل الشهادةء وعقد
الزواجء والتوكيلء وما إلى ذلكء هي قاعدة
الإستيمان التي ظهرت في عبارة ((ليس على
الأمين إلا اليمين)). على الرغم من شهرة هذه
القاعدة وتطبيقها على نطاق واسع في الفقه
والقانونء هناك الكثير من اخلافات حول هذا
الموضوع. تمتد هذه التناقضات في بعض الأحيان
ِى التقطة التي يتعرض فيها الإستيمان إلى
النقد أيضاء حيث اعتبر البعض أن الإستيمان
استثناء من قاعدة اليدء وليس قاعدة فقهية
مستقلة. القاعدة أو استثناءها من القاعدة
الفقهية ليست مناقشة نظرية ولكن لہا العديد
من الآثار العملية. في هذه الدراسةء سعينا
للإجابة على السؤالء وهو ما هي العلاقة بين
الإستيمان والضمان على اليد؟ كشفت دراسة
وصفية تحليلية أن الإستيمان هي قاعدة فقهية
مستقلة مع أحكامها وآثارها امحددة.
One of the privileges of
Imamiyah jurisprudence is the
subjective classification of topics
and the presentation of rules for the
ordering of the Shari'a rulings. It
has long been the case that jurists
have sought to derive partial rulings
