چکیده:
اگرچه وسایل نقلیه خودران را می توان انقلابی در صنعت حمل و نقل به حساب آورد، منتها این فناوری جدید که مبتنی بر هوش مصنوعی می باشد در کنار کارایی بالای خود، چالش هایی را نیز برای نظام مسئولیت مدنی فعلی ایجاد می نمایند و از آنجا که تصادفات همیشه جزء جدایی ناپذیری از وسایل نقلیه خواهند بود از همین رو ایجاد یک طرح جدید مسئولیت که تکالیف قانونی طرفین احتمالی این قبیل دعاوی را مشخص نماید بسیار مهم و ضروری است. تحقیق حاضر با رویکرد توصیفی -تحلیلی و با نگاه تطبیقی بر موضوع مسئولیت مدنی کاربر خودروی خودران به این نتیجه می رسد که برخلاف وسایل نقلیه معمولی که به طور سنتی بلافاصله راننده مسئول حوادث جاده ای معرفی می گردد در خصوص خودروهای خودران که هوش مصنوعی مستقر در آن به خودرو اجازه می دهد حتی در غیاب یک عامل انسانی هم بتواند حرکت کند و نیز در فرض وجود کاربر در خودرو -صرف نظر از موارد خاص – وی در حکم مسافر خودرو محسوب می گردد، لذا عملاً بحث از تقصیر به دلیل فقدان مشارکت در کنترل وسیله نقلیه که بتواند کاربر را قادر به تغییر رفتار آن نماید، منتفی است و در نتیجه دیدگاه فعلی با ساختار این خودروها هم خوانی ندارد و می بایست تعریف مجددی از قوانین سنتی به عمل آید و تا آن زمان اصل را می بایست بر مسئولیت شرکت سازنده خودرو در جبران خسارات زیان دیده قرار داد و مسئولیت کاربر را در این زمینه استثنایی قلمداد نمود.
Although self-deriving vehicles can be considered a revolution in the transportation industry, this new technology, which is based on artificial intelligence, in addition to its high efficiency, also creates challenges for the current system of civil liability, and since Accidents will always be an integral part of vehicles, so it is important to create a new liability plan that outlines the legal obligations of potential litigants. The present study, with a descriptive-analytical approach and a comparative view on the issue of civil liability of self-driving car users, concludes that unlike conventional vehicles, which traditionally immediately introduces the driver immediately responsible for road accidents, self-driving cars based on AI It allows the car to move even in the complete absence of a human factor, and also in the presence of the user - except in special cases - he is considered a passenger of the car, so in practice the discussion of guilt due to lack of participation in control A vehicle that can enable the user to change its behavior is ruled out, and as a result the current view is inconsistent with the structure of these vehicles, and the traditional rules must be redefined, and until then the principle must be the responsibility of the manufacturer The car compensated for the damage and considered the user's responsibility in this regard exceptional.

اين قطعنامه ، پيشنهادي براي تصويب يک سند قانوني در مورد مسائل حقوقي قابل پيش بيني مربوط به توسعه و استفاده از رباتيک و هوش مصنوعي ارائه نمود که کميسيون اروپا مي بايست در اين سند مشخص نمايد کدام يک از اين دو روش ذيل در رسيدگي به موضوع خسارات ناشي از به کارگيري اين محصولات بايد اعمال شود: اول اتخاذ روش مسؤوليت مطلق که بر اساس آن فقط به اثبات وقوع خسارت نياز باشد بدون آنکه بررسي و اثبات رابطه عليت بين عملکرد کاربران هوش مصنوعي و خسارتي که شخص آسيب ديده متحمل شده است ضرورتي داشته باشد.
