چکیده:
کتب و آثار دیجیتال کتابخانه های دیجیتال از حیث وضعیت حقوق چاپ و نشر و به ویژه وضعیت حقوقی دسترسی به آن ها به سه دسته تقسیم بندی می شوند؛ نخست، آثار دارای حق چاپ و نشر (مورد حمایت)؛ دوم، آثاری که صاحب حق چاپ و نشر آن ناشناس است و سرانجام، آثاری که تجدید چاپ نمی شوند. راه حلی که موجب تقویت کتابخانه های دیجیتال میشود، تعلق و اختصاص آثار ناشناس و آثاری که تجدید چاپ نمیشوند به حوزه عمومی (قلمروی همگانی) است. تبدیل این آثار به عنوان بخشی از مالکیت عمومی و همگانی، ارتباط اثر با خالق آن را قطع نمیکند و در واقع این آثار به طور کلی واجد یک خانواده شده و این خانواده(جامعه) از آن لذت برده و از منافع آن بهره مند خواهد شد. پیشنهادهای حقوقی بسیاری برای حل مشکل آثار واجد حق چاپ و نشر ارائه شده است. اصلاح قوانین کپی رایت و معافیت یا مستثنی شدن کتابخانه ها از دایره شمول قوانین کپی رایت و حمایت دادگاه ها از دکترین اسقاط حق در آثار دیجیتال از زمره ی این پیشنهادها است.
