چکیده:
سابقه تشکلهای صنفی در ایران، به زمانهای دور برمیگردد، اما با گذشت زمان نتوانستهاند نقش خود را بعنوان حلقه واسط بین دولت و مردم پیدا و جایگاه خود را در هرم قدرت تثبیت نمایند. در دوران کنونی، علیرغم تاکید و تصریح قانون اساسی به حق بر آزادی تشکیل و عضویت در نظامهای صنفی، در پرتو اصل(26)، صیانت ازآنها با تدوین قوانین کارآمد و منطبق بر نیازهای روز جامعه امکانپذیر است. از آنجا که نظامهای صنفی در حیطه و حوزه چندین دسته مختلف از قوانین بوده و توجه به این نکته که دولتها با توجه به گوناگونی و تنوع فراوان نیازهای جامعه قادر بتدوین قوانین کارآمد در همه حوزهها نبوده ، لذا استفاده از منابع دیگر حقوق مانند رویه قضایی لازم و ضروری به نظر میرسد. در ایران دیوان عالی کشور و دیوان عدالت اداری به عنوان مراجع رسمی با وظیفه نظارت قضایی - اداری، اصلیترین نهادهای قانونی تضمین حقوق و آزادیهای بنیادین نظام صنفی در کشور تلقی میشوند. ارتقای کارآمدی مراجع فوق در حوزه حقوق و آزادیهای بنیادین نظامهای صنفی و دستیابی تشکلهای صنفی، اتحادیهها، سندیکاها و ..... به آن، نیازمند توصیف وضع مناسب موجود و نقد آن همراه با ارائه الگوی مطلوب است. این مهم در ایالات متحده آمریکا بر عهده قضات دادگاهها، دیوانهای ایالتی و فدرال بوده که در صیانت از حقوق و آزادی نظامهای صنفی، قوانین را بصورت انعطافپذیر و منطبق بر حقوق فردی و گروهی تفسیر مینماید .
