چکیده:
زمینه و هدف: قانون عملیات بانکی بدون ربا در شهریور 1362 به منظور انطباق عملیات بانکها بر موازین اسلامی مورد تصویب قرار گرفت و از آغاز سال 1363 به مرحله اجرا درآمد. هدف، بررسی تاثیر وضع قانون عملیات بانکی بدون ربا در اسلامی کردن نظام بانکی و موسسات مالی و اعتباری میباشد. مواد و روشها: گردآوری اطلاعات با مطالعه دقیق قانون عملیات بانکی بدون ربا و بخشنامهها و دستورالعملهای اجرایی بانکها و آئیننامههای فصول مختلف این قانون به روش توصیفی تحلیلی انجام شد. ملاحظات اخلاقی: در تحقیق حاضر، اصول اخلاقی مانند ارجاع دهی و استناد به منابع اصلی رعایت گردید. یافتهها: از بـررسی رابـطـهای که بین سپرده گـذاران و بانـکها و بیـن بانـک و سرمایه گذاران بوجود میآید مشخص شد قانونگذار بیشتر درصدد توجیه رویه بانکها برآمده تا اینکه بخواهد سیاستهای پولی مطابق با موازین شرعی را اعمال نماید. نتیجهگیری: وقتی روابط بین بانک، سپرده گذاران و سرمایه گذاران با عقود اسلامی بطور کامل منطبق نباشد، بهتر است باستناد ماده ده قانون مدنی ویا در اصطلاح فقهی از باب مراضات اصل آزادی قراردادها که ریشه در عرف دارد وقتی مفسدهای وجود ندارد آن را نافذ بدانیم.
Background and Aim: The law on banking operations without usury was approved in September 1983 in order to adapt the operations of banks to Islamic standards, and it was implemented from the beginning of 1984. The aim is to investigate the impact of the law on usury-free banking operations in the Islamification of the banking system and financial and credit institutions.Materials and Methods: Gathering information was done by carefully studying the law of interest-free banking operations and the circulars and executive instructions of banks and the bylaws of different chapters of this law in a library method and with comparative analysis.Ethical Considerations: In this research, ethical principles such as referencing and quoting original sources were observed.Results: From the examination of the relationship between depositors and banks and between banks and investors, it is clear that the legislator is more interested in justifying the banks' practice than trying to implement monetary policies in accordance with Sharia standards.Conclusion: When the relations between the bank, depositors and investors are not completely in accordance with Islamic contracts, why is there any insistence to measure the relationship between the bank and the depositors, which is rooted in the customs of the banking profession, with the touchstone of contracts determined in jurisprudence? And what is the requirement to limit contracts to the same known number?
