چکیده:
قاعده لاضرر یکی از قواعد مسلم فقهی است که هم ادله نقلی و هم ادله عقلی آن را پشتیبانی میکنند. البته در مورد مفاد این قاعده نظرات متعددی مانند نهی از اضرار یا لزوم جبران ضرر یا امر سلطانی یا لزوم اتخاذ تصمیمات در جهت جلوگیری از اضرار یا نفی حکم ضرری و ... وجود دارد که تأثیر این قاعده بر امور اجتماعی و احکام شرعی مربوط به شهرنشینی قابلانکار نیست. با توجه به آنکه جلوههای گوناگونی از این قاعده در مسائل مربوط به شهر به چشم میخورد، بررسی میزان تأثیرگذاری قاعده لاضرر در امور عمرانی شهرهای اسلامی ضروری به نظر میرسد. پژوهش حاضر با روش تحلیلی- توصیفی ابتدا به بررسی میزان اعتبار و مفاد قاعده لا ضرر و نظرات پیرامون آن پرداخته است و سپس تأثیر این قاعده در پدیدههای عمرانی شهر را موردبررسی قرار داده است و در نهایت میتوان چنین نتیجه گرفت که طبق قاعده لاضرر تمامی عوامل که ابعاد مختلف عمرانی در شهرها را به مخاطره میاندازد. از نظر فقه اسلامی ممنوع بوده و این قاعده بر قاعده تسلیط تقدم دارد. بنابراین، شهروندان موظفاند در امور عمرانی مانند ساختن ساختمانهای چندطبقه یا دیوارهای مشترک یا ساختن سازههای بیرون ساختمان یا حضور در معابر عمومی یا اشراف پنجره بر خانه همسایه رعایت حقوق سایرین را کرده و در صورتیکه این امور منجر به ضرر آحاد جامعه شود، از نظر فقها ممنوع است.

Therefore, citizens are obliged to respect the rights of others in civil matters such as the construction of multi-storey buildings or common walls or the construction of structures outside the building or presence in public thoroughfares or windows overlooking the neighbor's house, and if these matters lead to harm to the community; It is forbidden according to the jurists.
