چکیده:
حقوق بین الملل به واسطه وقوع جنگ و ویرانیها شکل گرفته است و در طول زمان، به عنوان یک ابزار اساسی برای حفظ نظم در سطح جهان شناخته شده است. اگرچه سیاست جهانی به تدریج به ایجاد روابط میان دولتها و توسعه پیشرفت به واسطه ایجاد قوانین مشترک بین کشورها زمینه را برای تعامل هرچه بهتر بین المللی فراهم کرده است؛ اما این سیستم نیازمند ایجاد اصلاحات هرچه بیشتر است. بر همین اساس، این مقاله به بررسی روش اجرای هرچه کارآمدتر حقوق بین الملل در ارتباط با جنگ اوکراین میپردازد. سپس با استفاده از روش توصیفی-تحلیلی به بررسی چارچوب قانون کنونی، مکانیسمهای مختلف و روشهای موثر اجرا حقوق بین الملل میپردازد. از این رو مقاله حاضر، به معایب اجرای موثر این مکانیسمها در سطح بینالملل میپردازد و به ارائه پیشنهادهای مناسبی برای بهبود فرآیند اجرای این قوانین پرداخته است. همچنین در این تحقیق، بر جنگ اوکراین متمرکز است و مثالهایی از نقض حقوق بین الملل توسط کشور روسیه به عنوان یکی از اعضای دائم شورای امنیت سازمان ملل متحد برای تشخیص الگو مناسب برای عدم اجرا دقیق این قوانین بیان میکند و به توضیح مفاهیم خلاء مصونیت و عدم مسئولیت حقوقی به عنوان دو محور اصلی در اجرای حقوق بینالملل میپردازد و پیشنهادهایی را برای بهبود این محورها، از جمله ایجاد مدل نظارت مشترک، تقویت سازمانهای منطقه ای و تعامل اثربخش میان نظام های حقوقی و قضائی ملی و بین المللی، مطرح مینماید.
International law has been shaped by the occurrence of war and destruction, and over time, it has
been recognized as an essential tool for maintaining order in the world. Although global politics
has gradually created relations between governments and developed progress through the creation
of common laws between countries, it has provided the basis for better international interaction;
But this system needs to be reformed as much as possible. Based on this, this article examines the
method of implementing international law as efficiently as possible in connection with the war in
Ukraine. Then, using the analysis of the current legal framework and various mechanisms, it
examines the effective methods of implementing international law. Therefore, this article deals
with the disadvantages of the effective implementation of these mechanisms at the international
level and provides suitable suggestions to improve the implementation process of these laws. Also,
in this research, it focuses on the war in Ukraine and gives examples of violations of international
law by Russia as a permanent member of the United Nations Security Council to identify the
appropriate model for not strictly implementing these laws. It also explains the concepts of
immunity vacuum and lack of legal responsibility as two main axes in the implementation of
international law and offers suggestions for improving these axes, including creating a joint
monitoring model, strengthening regional organizations and effective interaction between national
and international legal and judicial systems.
