Abstract:
وقف تأسیسی دائمی و با استحکامی فراتر از سایر عقود است بهنحوی که بسیاری از فقهای امامیه و حقوقدانان کشورمان به کرات از دائمی بودن (تأبید) وقف و غیرقابلفسخ و تفاسخ بودن آن سخن گفتهاند. آمیختگی وقف با اعتقادات مذهبی و اجر اُخروی مترتب بر آن و آثار نیکوی اجتماعی و اقتصادی این نهاد، بر پایداری آن افزوده است بهگونهای که امروزه برخی اوقاف دارای قدمت بیش از هزار سال میباشند. علیرغم تأکید بر مؤبد بودن وقف، بررسی آثار فقهی نشان میدهد که برخی فقها در فروض خاص، امکان درج شرط خیار را در وقف پیشبینی کردهاند. مشهور فقها چنین شروطی را مورد پذیرش قرار داده و توجیهات و ادلۀ مختلفی برای اثبات صحت چنین شروطی مطرح شده است. قانون مدنی این دیدگاه را نپذیرفته است و از مواد مختلف آن استنباط میشود که تأبید و غیرقابلفسخ بودن وقف از خصایص ذاتی و غیرقابلانفکاک این عقد هستند و تحت هیچ عنوان نمیتوان در وقف، شرطی نمود که سبب بازگشت وقف به مالکیت واقف شود. لهذا آنچه بهعنوان شرط فسخ یا تفاسخ در برخی آثار فقهی مطرح شده، اساساً خارج از تأسیس وقف بوده و تحت عنوان سایر احباس نظیر مطلق یا عمری قابل بررسی است.
Endowment under Islamic law is a permanent type of contract which cannot be revoked and it is a consensus among Shiite jurisprudents. It is a kind of contract which has been based upon a religious thoughts as well as provides great heavenly reward and includes social and economic effects. These are special characters which lead Endowment to be a more concrete contract with special imperative rules.
But, a survey regarding jurisprudent books shows that, some of them sometimes let Endowment to be revocable by special stipulations in the contract, which is against the consensus on irrevocability of an Endowment. Although most of the Shiite jurisprudents accepted these stipulations, but some others are against them. In this article arguments relevant to both ideas are considered.
These stipulations are not accepted under the civil law of Iran and it can be deducted from it that Endowment cannot be revoked and are bounded from the time of contract.
