Abstract:
زمینه و هدف: افراد میتوانند از مقررات حقوقی که ابزار تنظیم روابط مردم هستند، در جهت تعرض به حقوق دیگران استفاده کنند. نهاد طلاق نیز یکی از این ابزارها میباشد. چنانچه زوج مبتلا به بیماری مشرف به موت باشد، این امکان وجود دارد که به قصد محروم ساختن زوجه از ارث، وی را طلاق دهد. هدف از پژوهش حاضر، بررسی این وضعیت میباشد. مواد و روشها: این تحقیق از نوع نظری بوده روش تحقیق به صورت توصیفی تحلیلی میباشد و روش جمعآوری اطلاعات بصورت کتابخانهای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. یافتهها: یافتههای پژوهش نشان میدهد که در فضای فقه امامیه و حقوق ایران، چنانچه مردی که مبتلا به بیماری مشرف به موت باشد، به دلیل بیم سوءاستفاده از حق، در صورت طلاق همسر، با وجود شرایطی، زوجه از وی ارث میبرد. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت-داری رعایت شده است. نتیجهگیری: ارث بردن زوجه در شرایط ابتلای زوج به یک بیماری مشرف به موت، از نظر فقهی و حقوقی یک وضعیت استثنائی محسوب نمیشود؛ بلکه باید آن را در قالب یک قاعدهی کلی در نظر گرفت.
Background and Aim: Individuals can use legal provisions, which are the tools of public relations, to infringe on the rights of others. Divorce is one of these tools. If the couple suffers from a terminal illness, it is possible to divorce the wife with the intention of depriving her of her inheritance. The purpose of this study is to investigate this situation.Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.Findings: Findings show that in the field of Imami Fiqh and Iranian law, if a man suffers from a disease overlooking death, due to fear of abuse of the right, in case of divorce of the wife, despite the circumstances, the wife inherits from him.Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.Conclusion: Inheritance of the wife is not an exceptional situation in jurisprudential and legal terms in the case of the husband suffering from a disease leading to death; Rather, it should be considered as a general rule.
