Abstract:
دولتها و بنگاهها در راستای خدماترسانی و انجام وظایف خود ناگزیر به انعقاد قراردادها با اشخاص دیگر (اعم از حقیقی و حقوقی) خصوصاً در رابطه با فرآیندهای مناقصه و مزایده میباشند. از آنجا که قانون برگزاری مناقصهها و مزایدهها، فاقد کارایی لازم بوده و خلاءها و ایرادات اساسی دارد، لذا این امر موجب اشاعه و توسعه زمینههای بروز فساد در این قراردادها (از طریق تبانی) گردیده است. در این مقاله روشی برای حذف تبانی با طراحی یک بازی ایستا و حل آن با استفاده از نظریه بازیها به منظور دستیابی به نقاط تعادلی نش، ارائه گردیده است. نتایج نشان میدهد که قیمت حداکثری که مناقصهگزار جهت حذف تبانی بین دو مناقصهگر انتخاب میکند بایستی از چه قیمتی پایینتر و همچنین قیمت حداقلی که مزایدهگزار جهت حذف تبانی بین دو مزایدهگر انتخاب میکند بایستی از چه قیمتی بالاتر باشد. نهایتاً پیشنهاد میگردد دولتها و بنگاههای برگزار کننده مناقصهها و مزایدهها از نتایج این تحقیق بهره گرفته و تبانی را با تعیین قیمتهای سقف و کف خنثی نمایند.
Governments and firms in accordance to their duties, obliged to inevitably contracts with Individuals and legal entities, especially in auction and tender process. Since, the law of conducting tenders and auctions is lacking efficiency and has major objection, therefore, this has led to the dissemination and development of areas of corruption in these contracts (through collusion). In this paper, in order to eliminate collusion, the Nash equilibrium points have been obtained by designing a static game and solving it using game theory. The results show the maximum of the ceiling prices, As well as the minimum of floor prices at which the bidder chooses to eliminate collusion between the two tenderers. At last, it is recommended that the governments and bidding firms use the results of this research and neutralize collusion by setting ceiling and floor prices.
