Abstract:
زمینه و هدف: پیشفروش، یکی از اقسام معاملات رایج در بازار، بهویژه بورس کالا است. بر اساس فقه اسلامی پیشفروش دارای احکامی است که ازجمله آن، عدم جواز فروش مبیع قبل سررسید است که از این مسائل مهم و اختلافی بین فقها است. با توجه بهپیش بینی این قرارداد، بهعنوان یکی از سازوکارهای معاملات بورسهای کالا، این سؤال مطرح میشود که آیا فروش کالا قبل از سررسید در بازار سنتی، بهویژه بورس صحیح است؟
مواد و روشها: روش تحقیق در این مقاله بهصورت توصیفی بوده است.
ملاحظات اخلاقی: تمامی اصول اخلاقی در نگارش این مقاله رعایت شده است.
یافتهها: یکی از احکام قرارداد پیشفروش، فروش مبیع قبل از سررسید در بازار ثانویه است که مورد اختلاف آرا، بین فقها است. برخی از فقها برای ممنوعیت عدم جواز، به دلایلی استناد کردهاند که عبارت از اجماع، روایت و... است و همچنین راهکارهای جواز فروش آن ازجمله، در قالب صلح، وکالت، حواله و... است که مورد بررسی و تبیین قرار گرفت.
نتیجهگیری: فروش مبیع قبل از سررسید بر اساس فقه و حقوق اسلامی، جایز است زیرا با انعقاد عقد همانطور که فروشنده مالک ثمن (پول) است و در آن تصرف میکند در مقابل خریدار مالک کالای سلفی میشود و این ملک طِلق او است.
Background and Aim: Pre-sale is one of the most common transactions in the market, especially the commodity exchange. According to Islamic jurisprudence, pre-sale has rulings, including the lack of license to sell goods before the maturity, which is one of these important issues and a disagreement among jurists. Considering the acceptance of this contract, as one of the mechanisms of commodity exchange transactions, the question arises whether the sale of goods before the maturity in the traditional market, especially the stock exchange is correct?
Materials and Methods: It is descriptive study.
Ethical Considerations: All ethical considerations have been observed.
Findings: One of the rulings of the pre-sale contract is the sale of goods before the maturity in the secondary market, which is disputed by jurists. Some jurists have invoked the prohibition of non-licensing for reasons such as consensus, narrative, etc. And also its sales license solutions, including, in the form of lawyers, transfers, etc. It was investigated and explained.
Conclusion: It is permissible to sell the goods before the maturity according to Islamic jurisprudence and law, because by concluding the contract, as the seller owns the money and seizes it, in return, the buyer becomes the owner of the goods.
