Abstract:
زمینه و هدف: جبران خسارات زیستمحیطی دریایی از موضوعات مهم ضمانت اجرای حمایت از محیطزیست دریاهاست. در این مقاله تلاش شده، جبران خسارات زیستمحیطی دریایی و رویکرد سازمان بینالمللی دریانوردی (آیمو) در این خصوص بررسی شود.مواد و روشها: مقاله توصیفی تحلیلی بوده و از روش کتابخانهای استفادهشده است.ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانتداری رعایت شده است.یافتهها: سازمان بینالمللی دریانوردی با تأسیس صندوق بینالمللی برای پرداخت غرامت برای خسارت آلودگی نفتی، ایجاد سازوکار مسئولیت و پرداخت غرامت برای خسارت مرتبط با حملونقل مواد خطرناک و سمی، پرداخت خسارت آلودگی ناشی از سوخت کشتیها و تدوین الزامات مربوط به برداشت و شناورسازی کشتیهای مغروقه، اقدامات متعددی در زمینه جبران خسارات زیستمحیطی دریایی به عملآورده است.نتیجهگیری: سازمان بینالمللی دریانوردی با شناسایی برخی تهدیدات محیط زیستی دریایی و زمینهسازی جهت تدوین و تصویب برخی از کنوانسیونها و مقررات بینالمللی بهصورت مؤثری بر جبران خسارت زیستمحیطی دریایی نقش مثبت ایفا کرده است اما واقعیت امر این است که اقدامات سازمان مذکور صرفاً بخشهای خاصی از دریانوردی را شامل میشود و از طرفی ماهیت آلودگیهای زیستمحیطی دریایی، بحث جبران را با چالش مواجه میکند زیرا گاها تعیین میزان دقیق خسارت بهسادگی امکانپذیر نیست.
