Abstract:
ظلم به حیوانات از جرایم شناخته شده در حوزه های قضایی مختلف است . تدارک آب و خوراک مناسب ،
شرایط زیستی و روانی صحیح و لزوم دسترسی به بهداشت و درمان از جمله مهم ترین حقوق حیوانات میباشد
که در حقوق داخلی، در قانون اساسی جمهوری اسلامی ایران و قوانین کیفری به این مسئله به طور خاص توجه
شده است و در عرصه بین المللی نیز اسناد بین المللی متعددی در زمینه حفاظت محیط زیست حمایت از حقوق
حیوانات منعقد شده است ولی با این وجود شاهد نقض گسترده حقوق حیوانات در سطح ملی و بین المللی
میباشیم . متاسفانه مقررات کیفری ایران از این جهت بسیار ناقص بوده و به جز مقررات معدودی ، مستند عام در
این خصوص ندارد. با توجه به عدم وجود بسترهای فرهنگی لازم در ایران و وجود رگه هایی از مذهب در
قوانین ، در حال حاضر قوانین سختی در خصوص جرم انگاری حیوان آزاری در مقررات کیفری ایران وجود ندارد
و آزار و کشتار حیوانات رواج بسیاری در ایران دارد که عدم حمایت از امنیت زیست حیوانات و مجازات نشدن
آزاردهندگان ، اعتراضات فراوانی را به همراه داشته است . در تحقیق حاضر، سعی بر این است با استفاده از روش
توصیفی-تحلیلی جرایم علیه حیوانات و حقوق آنان را مورد بررسی قرار دهیم .
Cruelty to animals is a well-known crime in various jurisdictions. Proper provision of water and food, proper living and psychological conditions and the need for access to health care are among the most important animal rights, which are specifically addressed in domestic law, the Constitution of the Islamic Republic of Iran and criminal law. In the international arena, numerous international instruments in the field of environmental protection and protection of animal rights have been concluded, but nevertheless, we are witnessing widespread violations of animal rights at the national and international levels. Unfortunately, Iran's criminal regulations are very flawed in this regard and, except for a few regulations, there is no general documentation in this regard. Due to the lack of necessary cultural contexts in Iran and the existence of traces of religion in the laws, there are currently no strict laws regarding the criminalization of animal abuse in Iran's criminal regulations and the persecution and killing of animals is very common in Iran. Supporting the biosafety of animals and not punishing abusers has led to many protests. In the present study, we try to examine the crimes against animals and their rights using a descriptive-analytical method.
