Abstract:
قانون مدنی ایران تحت شرایطی به یابندة لقطه (مال گمشده) اجازة تصرّف و تملّک را داده است. لیکن سؤالی که مطرح میشود این است که چنانچه شخص یابندة لقطه برخلاف مقرّرات قانونی نسبت به تصرّف و تصاحب لقطه اقدام نماید، آیا عمل ارتکابی وی جرم محسوب میشود؟ در پاسخ به سؤال مذکور بین حقوقدانان اختلاف نظر وجود دارد. گروهی معتقدند که تصرّف خلاف قانون درمال لقطه جرم است، لیکن در خصوص اینکه عنوان مجرمانة عمل ارتکابی چیست اتّفاق نظر وجود ندارد. گروهی قائل به سرقت، گروهی معتقد به خیانت در امانت، برخی قائل به انتقال مال غیر و گروهی نیز معتقد به تحصیل مال از طریق نامشروع هستند. در مقابل، عدّهای دیگر از حقوقدانان معتقدند که تصرّف برخلاف قانون در مال لقطه فاقد وصف مجرمانه است. نتیجه آنکه نظر گروه اخیر از قوّت بیشتری برخوردار بوده و تصرّف در مال لقطه هرچند برخلاف مقرّرات قانونی باشد جرم نیست.
Iran's civil law allows the finder (lost property) to possess it under certain conditions. However, the question that arises is whether it is a crime if the person who found the property seizes the property. There is disagreement among lawyers about this question. Some believe that illegal seizure is a crime, but there is no consensus on what a criminal offence is. Some believe in theft, some in abuse of confidence, some in the transfer of property of others, and some in the acquisition of property through illegitimate means. On the other hand, some jurists believe that the illegal seizure of property is not a crime. The results of the present study indicate that the opinion of the second group is stronger and seizure of property is not a crime even if it is against the law.
