Abstract:
مرحله دادرسی در فرایند کیفری اهمیت بسیاری دارد. زیرا، در این مرحله است که سرنوشت دعوای کیفری و نوع یا ماهیت پاسخ های حقوق کیفری به بزهکاران تعیین میشود. در گستره حقوق کیفری کودکان و نوجوانان، این مرحله از حساسیت بیشتری برخوردار است. چرا که کودکان و نوجوانان بزهکار در مرحله رشد و پرورش قرار دارند و اتخاذ هرگونه تصمیم از سوی نظام عدالت کیفری میتواند در آینده رفتاری آنان تاثیرگذار باشد.در این میان، مرجع صادر کننده حکم برای کودکان و نوجوانان، یکی از مهمترین عوامل در مبارزه با بزهکاری این دسته و پیشگیری از تکرار آن، به شمار میآید. به منظور تامین هدف مقدس حمایت از منافع و مصالح عالیه کودکان و نوجوانان معارض با قانون، با وجود این که اصل تساوی افراد در برابر قانون و دادگاه ها در قوانین اساسی (اصول 19 و 20 قانون اساسی جمهوری اسلامی ایران) متضمن ممانعت از تشکیل دادگاه های ویژه در رسیدگی به جرایم گروه های اجتماعی خاص است، لیکن با توجه به دستاوردهای علوم جنایی و جرمشناسی و توصیه اسناد بین المللی، در نظام های دادرسی کیفری غالب کشورها، دادگاه ویژه اطفال با صلاحیت اختصاصی رسیدگی به اتهامات اطفال و نوجوانان تشکیل شده است.بند سوم قسمت «ب» ماده 40 پیمان حقوق کودک، تشکیل مرجع قضایی واجد صلاحیت مستقل و بی طرف را در مورد رسیدگی به اتهام اطفال و نوجوانان پیش بینی و مقرر کرده است.
