Abstract:
معاملات فضولی از واقعیات انکارناپذیر در جامعه کنونی ما میباشند و انجام اینگونه معاملات افراد را با اثرات و تبعات آن مواجه ساخته است تا جایی که در محاکم، رسیدگی قضایی نسبت به این موارد مشاهده میشود. درخصوص ماهیت معامله فضولی باید اذعان کرد عقدی است جامع ارکان و دارای شرایط عقود که صرفاً به این علت که آثار آن به دارایی یا شخصیت غیر باز میگردد با مانع مواجه شده و نفوذ این نوع از عقود منوط به برطرف شدن مانع بوسیله اعلام اجازه است. فضول بر طبق ماده 247 قانون مدنی کسی است که بدون داشتن سمت، اقدام به معامله برای خود یا برای غیر می نماید بدون این که از طرف مالک اذن داشته باشد. درخصوص آثار اعمال حقوقی فضول با بررسی و جستجو درخصوص عقود و ایقاعات فضولی می توان به این مهم دست پیدا کرد که این آثار در اکثریت عقود و ایقاعات فضولی مشترک است و حتی مسئولیت مدنی فضول در ضمانات قهری فضولی نیز از آن متأثر می گردد. همچنین گستره معاملات فضولی در جامعه امروز به حدّی بوده است که از معاملات صرفاً خصوصی فراتر رفته تا جایی که در بسیاری از معاملات اداری و دولتی شاهد اینگونه از قراردادها می باشیم و به طور کلی در این راستا با سه نوع از معاملات: صحیح، باطل و غیرنافذ ولو به صورت ظاهری مواجه هستیم
