Abstract:
هذه الدراسة، التي أجريت بالمنهج الوصفي التحليلي، تعد حقوق المواطنة مزيجًا من واجبات ومسؤوليات المواطنين تجاه بعضهم البعض، والمدينة والحكومة أو السلطات الحاكمة، بالإضافة إلى الحقوق والامتيازات التي تقع على عاتق مديري المدينة أو الحكومة أو السلطات الحاكمة بشكل عام. وبحسب تعاليم نهج البلاغة، فإن حقوق الحاكم أو الحكومة والمواطنين متبادلة. في دستور جمهورية إيران الإسلامية، تم ذكر حقوق الشعب في ۲۳ أصلًا، حيث ينظر المشرع في حقوق المواطنة. تنقسم هذه الحقوق إلى ثلاث فئات: الحقوق المدنية والسياسية - الحقوق الاقتصادية والاجتماعية والثقافية - الحقوق القضائية، حيث تمت الإشارة إلى أهم الأمثلة عليها بالاستناد إلى أقوال الإمام علي (ع) ومنها حق تقرير المصير والحرية السياسية والولاء للحاكم كأمثلة على الحقوق المدنية والسياسية وتطبيق العدالة والتنوير والاهتمام بالتعليم كأمثلة على الحقوق الاقتصادية والاجتماعية والثقافية. أما في مجال الحقوق القضائية، فيجب على الحاكم إنشاء محاكم سليمة لإنفاذ حقوق المواطنين واتخاذ الإجراءات اللازمة لإقامة الحدود الإلهية. يمكن أن يؤدي احترام الحقوق المدنية إلى حفظ كرامة وسلطة الحكومة الإسلامية، وإقامة العدل في المجتمع وغيرها، وعدم احترام هذه الحقوق يمكن أن يكون له آثار ضارة.
In this study, which is based on a descriptive and analytical method, citizenship rights are a mix of duties and responsibilities of citizens toward one another, the city and the government or the ruling forces, as well as the rights and privileges that are the responsibility of city managers, government or in general the ruling forces. According to the teachings of Nahj al-Balaghah, the rights of the ruler or the government and the citizens are mutual. In the Constitution of the Islamic Republic of Iran the rights of the nation are mentioned in 23 principles in which citizenship rights are considered by the legislator, and are divided into three categories: Civil and political rights- Economic, social and cultural rights- Judicial rights. The most important examples of these rights are based on the words of Imam Ali PBUH which can be used to determine the right to self-determination, political freedom, loyalty to the ruler as examples of civil and political rights and justice, education and attention to education as examples of economic, social and cultural rights. In the field of judicial law, the ruler must take action to enforce the rights of citizens by creating sound courts and take the necessary measures to establish the divine limits. Observance of civil rights can lead to the dignity and power of the Islamic system, the creation of justice in society, and so on and non-observance of the mentioned rights can have harmful effects.
