Abstract:
در این مقاله به دنبال پاسخ به این پرسش هستیم که چه نوع جبران خسارت هایی در حقوق ایران برای افراد بازداشت شده بی گناه قابل پیش بینی است و این گونه های جبرانی با چه روشهایی اعمال می شود. در واقع مهمتر از خسارات مادی ، آنچه در بازداشت افراد ممکن است ایجاد شود خسارات معنوی است. خسارت معنوی خسارات وارد بر روح، جسم، اعتبار، احساسات و عواطف یا هرگونه خسارت وارد بر شخص و شخصیت او را شامل میشود. ارزیابی خسارت در جبران خسارت معنوی با مشکلات بسیاری مواجه است.زیرا عوامل مختلفی در این رابطه درگیر می شوند که نمی توان با قطعیت و با استناد به اصول ارزیابی خسارت، به ارزیابی این گونه خسارتها پرداخت. تفاوت های روحی و شخصیتی افراد، جایگاه اجتماعی آنان و مشکل تعیین واقعی میزان خسارات روحی و معنوی از جمله این موضوعات هستند. بنابراین به آسانی نمیتوان بین این دو حد از شدت و ضعف، ملاک و قاعده ایی عمومی و ثابت که قابل انطباق بر همه افراد باشد به دست داد و اصولاً قاعده مسلمی در این رابطه وجود ندارد اما آنچه که در این نوشتار به عنوان مهمترین مولفه های مد نظر در ارزیابی خسارت اشاره شد تأثیر ویژگی های شخصیتی و جایگاه اجتماعی بازداشت شونده و تأثیر عناصر معنوی و انگیزه بازداشت کننده بود و در خصوص روش های جبران خسارت معنوی ناشی از بازداشت افراد بی گناه نیز سه روش قانونی، توافقی و قضایی مطرح و مورد بحث قرار گرفته است.

These include differences in the mental and personality of individuals, their social status and the difficulty of determining the true extent of psychological damage. Therefore, it is not easy to find a general and fixed criterion and rule between these two levels of strength and weakness that is applicable to all people, and in principle there is no definite rule in this regard, but what in this article as the most important components The effect of personality and social status of the detainee and the effect of spiritual elements and motivation of the detainee were considered in the assessment of damages. Has been discussed
