Abstract:
کودکان و نوجوانان در فرآیند کیفری، به علت آسیبپذیری بالا، نیازمند رویکردی افتراقی نسبت به بزرگسالان هستند تا علاوه بر بازپروری، اثرات سوء این فرآیند به حداقل رسد. طبق نظریههای جرمشناسی (از جمله، نظریۀ برچسبزنی)، تحمیل برچسبهای مجرمانه میتواند دیدگاه جامعه را نسبت به به کودک و نوجوان تغییر داده و این باور نادرست را در فرد ایجاد کند که ذاتا مجرم است. این تصور میتواند او را در جهت ارتکاب اعمال مجرمانه دیگری سوق دهد و بازگشت به زندگی عادی را دشوار گرداند. در نتیجه، شیوه دادرسی و واکنشهای تعیینشده برای آنان، همواره باید مورد توجه قرار گیرد. به عنوان یک مطالعۀ تطبیقی، دو کشور ایران و کانادا در جدیدترین قوانین خود، نسبت به رسیدگی به جرائم کودکان و نوجوانان معارض با قانون، گامهای مثبتی در مسیر قضازدایی و کاهش میزان حضور این دسته از بزهکاران در فرآیند کیفری برداشتهاند. این دو کشور اگرچه در مراحل دادرسی و پسادادرسی اقدامات نسبتا مشابهی مانند کاهش مدت زمان نگهداری در مراکز بازپروری، تعلیق مجازات، آزادی مشروط، قرارهای نظارتی و عدم ثبت سابقه کیفری مقرر نمودهاند، اما در مرحله پیشادادرسی، نظام کیفری کانادا را ـــ با توجه به پیشبینی تدابیر فراقضایی و تشکیل پلیس ویژه کودکان و نوجوانان ـــ میتوان نسبت به ایران یک گام جلوتر برشمرد.
Today, it is important how juvenile delinquents are treated in the criminal process. Children and adolescents, due to high vulnerability, need different criminal process compared to adults in order to minimize the adverse effects of this process. Also, Following the tenets of the criminological theories (such as Labelling theory), if criminal labels are imposed on children and adolescents, the society's view of that juveniles will be changed. This belief can lead them to commit other criminal acts or make it difficult for them to return to a normal life. Thus, the responses and process of imposing them must always be considered. In recent years, Iran and Canada have taken some important steps to prosecute the crimes of juveniles and reduce their presence in the criminal process. These penal systems, although in the stages of trial and post-trial, provides almost the same measures such as reducing the length of detention in the rehabilitation center, suspension of sentences, probation, supervision orders and non-registration of criminal record. However, in the pre-trial stage, Canada is more advanced because of providing Juvenile Police and Pre-Trial Measures.
