Abstract:
اضطرار یکی از عناوین ثانویه و از قواعد مشهور فقهی است که در ابواب مختلف فقه و حقوق کاربرد دارد. فقها عمده بحث اضطرار را در کتاب اطعمه و اشربه مطرح کردهاند و در کتاب حدود و قصاص، یا این بحث مطرح نشده و یا اجمالاً به آن اشاره کردهاند و کمتر به ادله و مستندات آن به صورت متمرکز پرداختهاند. با عنایت به اینکه بحث اضطرار، یک قاعده قرآنی و روایی است، لذا در این مقاله به صورت توصیفی ـ تحلیلی، ادله و مستندات قرآنی آن به صورت کامل و دقیق بحث و بررسی شده است. براساس آیات شریفه، اضطرار از علل موجهه جرم است و عملی که مضطر در حال اضطرار انجام میدهد در صورتی که شرایط مذکور در آیات را داشته باشد، جرم نبوده تا از مجازات او صحبت شود؛ به نظر میرسد با توجه به اطلاق ادله قرآنی، میتوان قائل شد که اضطرار در حدود و تعزیرات هم از علل موجهه است و فرد مضطر مجازات نمیشود. در بحث قصاص هم در برخی از صور مثل جنایت بر عضو، اضطرار از علل موجهه است.
Emergency is a secondary title and it is one of the common jurisprudential rules used in different areas of jurisprudence and law. Jurists have mainly raised the issue of emergency in the field of foods and drinks and it has not been raised in the field of hodud and qisas and its arguments and reasons have not been addressed in a focused manner. Since emergency is a rule mentioned in the Holy Quran and narratives, in the present article, the Quranic arguments and evidences are fully and accurately discussed through a descriptive-analytical method. According to the Quranic verses, emergency is a justified reason for crime and the action conducted by someone in emergency is not seen as crime eligible for punishment provided that it enjoys mentioned conditions in Quranic verses. It seems that considering Quranic arguments, one can say that in hodud and canonical punishments, emergency is one of the justified reasons and the person in emergency is not punished. In qisas, also, emergency is seen as a justified reason in some cases such as crime against a body organ.
