Abstract:
فروانی پرونده های مطروحه در کمیسیون های ماده 100 قانون شهرداری در ایران و پیچیدگی های آن ها در نحوه دادرسی و حل و فصل اختلافات بین اشخاص و نمایندگان قدرت عمومی ، لزوم اصلاح قوانین و مقررات مرتبط در حوزه نظارت و رسیدگی به تخلفات ساختمانی را اجتناب ناپذیر می نماید. این موضوع به نحو دقیق و گسترده ای با ضمانت های اجرایی موثر و استفاده از اهرم های قانونی از جمله انطباق با مقررات، تخریب، توقف فعالیت، جریمه مالی و حبس در کشور سنگاپور تحت قانون کنترل ساختمان مصوب 1 می 1989 با آخرین اصلاحات و الحاقات مورخ 1 مارس 2019 پیش بینی گردیده است. مضافاً آن که تخلفات اشخاص حقوقی و دستگاه های حاکمیتی مورد توجه قرار گرفته است و در پاره ای از موارد وضع مقررات و رسیدگی به شکایات را در صلاحیت شخصی حقیقی( وزیر-Minister) قرار داده است که به علت پیشرو، نوآورانه و موثر بودن آن ها، تحقیق در خصوص تجربیات این کشور در مدیریت و برخورد با تخلفات ساختمانی را از طریق اصلاح قوانین و مقررات مرتبط به ویژه ماده 100 الحاقی 27/11/1345 قانون شهرداری مصوب 11/04/1334 را مهم و ضروری می نماید.
