Abstract:
اصلیترین مسئله در فقه سیاسی، تعیین حاکم سیاسی جامعه است. نبود شرایط تشکیل حکومت اسلامی برای شیعیان، باعث شده است که فقیهان شیعه به صورت مستقیم و در قالب بابی مستقل، این مسئله را مورد بحث قرار ندهند. در عین حال عموم فقیهان شیعه در لابهلای ابواب فقهی، بحث از تصدیگری در عصر غیبت و اختصاص این منصب به فقیه جامعالشرایط را کمابیش مورد توجه خویش قرار دادهاند. تحقیق حاضر این پرسش را مورد توجه خویش قرار داده که آیا شهید اول و شهید ثانی به عنوان فقیهان طراز اول عصر خویش، به این مسئله توجه داشته و آن را مورد بحث قرار دادهاند؟ این تحقیق با بررسی اندیشه این دو فقیه برجستۀ شیعی به روش توصیفی ـ تحلیلی، به این پرسش پاسخ مثبت داده و نشان میدهد که شهیدین از رهیافت ولایت فقیه به صورت بارز حمایت نموده و بر این عقیدهاند که این رهیافت، راه حل تمامی مشکلات و مسائل جامعه است. شهید اول در اثبات مسئله ولایت فقیه تنها به دلیل عقلی استناد جسته و از ادله نقلی به صورت مستقیم استفاده نکرده است؛ لکن شهید ثانی برای اثبات این امر از هر دو روش عقلی و نقلی بهره جسته است.
The main issue in political jurisprudence is the appointment of a political ruler. A lack of propitious conditions and circumstances for the formation of an Islamic government for the Shiites has led Shiite jurists not to discuss it directly and as an independent chapter. At the same time, most of the Shiite jurists have more or less paid attention to the discussion of holding positions in the age of occultation of the Infallible Imam(a). In their discussions, they have stated that this position is for a qualified jurist. The present study has addressed the question of whether the First Martyr (Muhammad Jamaluddin al-Makki al-ʿAmili) and the Second Martyr (Zayn al-Din al-Juba'i al-ʿAmili), as the early jurists of their time, have paid attention to this issue and discussed it or not. The present study aiming to examine the thought of these two prominent Shiite jurists, has answered this question in a descriptive-analytical manner. It shows that the martyrs have clearly supported the approach of Wilayat-i Faqih (governance of the jurist). They maintain that this approach is the solution to all the problems and issues of society. To prove Wilayat-i Faqih, the First Martyr has cited only rational reasons and has not directly touched on any textual proofs. Shahid Thani (the Second Martyr) has used both rational and narrative methods to prove the authority and guardianship of the jurist.
