Abstract:
جرائم زیستمحیطی در سطح جهانی میتوانند زندگی بشری را به نابودی بکشانند، به همین دلیل میتوانند در ردیف جنایات مهم بینالمللی قرار گیرند. در سالهای بعد از جنگ جهانی دوم انسانها به اهمیت محیطزیست و همچنین سلامت آن توجه بسیار کردند و در معاهدات مختلفی به حفاظت و حمایت از آن در برابر جنگ و سلاحهای شیمیایی و هستهای و همچنین در برابر جنایتهای مختلف تأکید بسیار داشتند. اصولاً برای پیشگیری از جرائم زیستمحیطی، اینگونه اقدامات میبایست جزو جرائم کیفری شناختهشده و برای مرتکبان جرائم زیستمحیطی مجازات تعریف شود؛ تنها در این صورت است که میتوان جنایات زیستمحیطی را در ردۀ جنایات مستقل بینالمللی قرار داد. در تحولات سالهای اخیر در دیدگاه دیوان کیفری بینالمللی نسبت به جنایات زیستمحیطی امید میرود که این دیوان بینالمللی بتواند این جنایات را بهعنوان یک جنایت مستقل شناسایی و در اساسنامه برای آن خطمشی تعریف کند. ازاینروست که در این مقاله با استناد به روش توصیفی تحلیلی قصد تبیین امکان شناسایی جنایت علیه محیطزیست بهعنوان یک جنایت مستقل را داریم.
Global environmental crimes could destroy human life; thus, they can be considered as major international crime. In the years since World War II, close attention has been paid to the importance of the environment as well as its health. In various treaties, support and protection of environment against war, chemical and nuclear weapons, as well as other crimes were emphasized. The author of this article believes that in order to prevent environmental crimes, they should be recognized as criminal offences and the perpetrators be punished. Only then they can be classified as separate international crime. Moreover, recent developments in the International Criminal Court's approach to environmental crimes make it possible for the Court to recognize them as a separate crime and define its policy in its Statute. As a result, this article seeks to explain the possibility of identifying crimes against the environment as separate crimes.
