Abstract:
بررسی ضمان پزشک در مواجهه با بیماران کروناییچکیدهزمینه: شیوع جهانی ویروس کرونا به عنوان یک بیماری همه گیر یکی از بحرانی ترین شرایط را پیش روی نظام جهانی گذارده است و عملاً کشورها با چالش های جدید سیاسی، اجتماعی و اقتصادی روبرو شده اند اما روی دیگر این موضوع تبدیل این چالش به فرصت برای بازتعریفی از پدیده های علمی است. در عرصه حقوق کیفری نیز این تجربه می تواند در رشته های مختلف علوم جنایی حقوقی مثل حقوق کیفری و علوم جنایی تجربی مانند جرم شناسی تاثیرگذار باشد. یکی از مقوله های مهم در این عرصه مسوولیت پزشک در این شرایط خطیر می باشد.روش: این مقاله به روش توصیفی و تحلیلی ضمن توجه به قواعد و اصول بنیادین مرتبط با مسوولیت پزشک در فقه و حقوق موضوعه به بررسی این امر در شرایط خاص بیماری کرونا می پردازد.یافته ها: یافته های این پژوهش حاکی از آن است که اولاً در شرایط خاص کرونایی بار اثبات تقصیر از پزشک برداشته می شود ثانیاً به دلیل آن که پزشک در درمان بیماران از معلومات و دانش زمان خود بهره می برد و ابعاد موضوع درمان بیماران کرونایی از منظر عرف خاص پزشکی کماکان مجهول می باشد لذا مفهوم تقصیر در این موارد باید تغییر یابد ثالثاً در برخی صور مثل واکسیناسیون ضمان بر عهده دولت و نه کادر درمان می باشد.
AbstractBackground: The global outbreak of the coronavirus as an epidemic has posed one of the most critical conditions for the global system, and in practice countries are facing new political, social and economic challenges, but on the other hand, this issue has become an opportunity to redefine It is a scientific phenomenon. In the field of criminal law, this experience can be effective in various fields of legal criminal sciences such as criminal law and experimental criminal sciences such as criminology. One of the important issues in this field is the responsibility of the doctor in this serious situation. Method: This article descriptively and analytically examines the issue in specific conditions of Patients with Koronavirus disease while paying attention to the basic rules and principles related to physician responsibility.Findings and Results: The findings of this study indicate that, firstly, in certain coronary conditions, the burden of proving guilt is removed from the physician. Secondly, the physician uses the information and knowledge of his time in the treatment of patients, but of course the dimensions of the subject of treatment of coronary patients are still unknown due to special medical practice, so the concept of guilt changes in these cases. Third, in some cases, such as vaccination, the guarantee should be the responsibility of the government and not the medical staff.
