Abstract:
از مسائل مهم و مبتلابه که در پرتو فقه و حقوق نوین باید به آن پاسخ داده شود، مسئله جواز یا عدم جواز اهدای اعضای بدن محکومان به اعدام و قصاص است. در بسیاری از نظامهای حقوقی موضوع امکان پیوند اعضای محکومان به مرگ به بیماران نیازمند مطرح و مجاز اعلام شده است. این موضوع از نظر فقه و حقوق موضوعه ایران قابل بررسی است. این پژوهش که با روش توصیفی، تحلیلی نگارش شده است، به بررسی این سؤال مهم میپردازد که رویکرد شارع مقدس نسبت به چنین امری چیست؟ ابواب اضطرار و تزاحم تا حد زیادی مرتبط با این موضوع هستند. با توجه به شرایط اضطراری در جامعه اسلامی، اجازه برداشت اعضای محکومان به مرگ، چه مهدورالدم باشند و چه نباشند، در اتاق عمل خواهد بود. این موضوع از بعد دیگر نیز قابل بررسی است بدین نحو که در شرایط غیر اضطراری نیز، در مجازاتهای اعدام غیرحدی، میتوان به جای طناب دار، جان محکوم را در اتاق عمل ستاند، زیرا قصاص با شمشیر به علت جلوگیری از ایذای محکوم میباشد و همچنین اینکه از اعضای قابل پیوند وی نیز میتوان استفاده نمود. البته در این صورت اجازه وی شرط است. این امر به موجب ماده 47 آییننامه نحوه اجرای احکام حدود، سلب حیات، قطع عضو، قصاص نفس و عضو و جرح، دیات، شلاق، تبعید، نفی بلد، اقامت اجباری و منع از اقامت در محل یا محلهای معین، مصوب 1398 مجاز شمرده شده است.

His transplantable members can also be used. Of course, in this case, his permission is a condition. This is in accordance with Article 47 of the By-Laws on Execution of Limits on Limits, Deprivation of Life, Amputation, Retribution and Injury, Diyat, Whipping, Exile, Denial of Knowledge, Compulsory Residence and Prohibition of Residence in a Certain Place or Neighborhoods Is allowed.
