Abstract:
مالکیت و حقوق ناشی از آن همواره مورد تکریم و حمایت و البته از سوی دیگر مورد تحدید و سلب قرار گرفته است. در قوانین و مقررات موضوعه، با وجود آنکه مالکیت از جمله حق اساسی انسانها است، ممکن است در پارهای ضروریات مانند تأمین منافع و مصالح عمومی جامعه، مورد تخدیش و تحدید قرار گیرد بنحوی که این خدشه منجر به سلب آن و انتزاع ملک از مالک بینجامد. قانونگذار اسلامی سعی بر آن داشته است که سلب مالکیت با رعایت حقوق مالکانه و بنا بر ضروریات جامعه صورت گیرد. بدین خاطر، تمهیداتی مانند پیشبینی دیوان عدالت اداری و شورای نگهبان در راستای صیانت از مالکیت خصوصی اندیشیده شده است. این مقاله به روش کتابخانهای تدوین شده است پرسش این است که دیوان عدالت اداری به چه نحو میتواند از سلب مالکیت اشخاص ممانعت یا حمایت بعمل آورد البته نتیجه حاصله آن است که دیوان عدالت اداری نمیتواند به تنهایی و بدون حمایتهای قانونی، از سلب مالکیت ممانعت بعمل آورد و یا حق مالکیت را بطور مطلق مورد حمایت خویش قرار دهد.
Property and the resulting rights have always been respected and protected, and inevitably, restricted and deprived. Although property is one of the basic human rights in the relevant laws and regulations, it may be violated and restricted in some necessities such as securing the public interests of society, so that the damage leads to its deprivation and abstraction of property from the owner. The Islamic legislator has tried to expropriate property in accordance with property rights and according to the needs of society. Therefore, measures such as the provision of the Court of Administrative Justice and the Guardian Council have been considered in order to protect private property. In this article, which has been compiled in a library method, we will be in a position to answer the question of how the Court of Administrative Justice can prevent or protect persons from expropriation. However, the result is that the Court of Administrative Justice cannot prevent from expropriation alone or without legal protection or fully protect the right to property.
