Abstract:
یکی از مباحث اختلافی در بحث نکاح، معاملهای بودن آن است. با توجه به آرای مختلف، دو نظریه در رابطه با عقد نکاح مطرح است؛ عدهای قائل به معاوضی بودن آن هستند و عدهای دیگر به غیرمعاوضی بودن آن معتقدند. البته دراینبین، فرضیه شبه معاوضی بودن آن نیز مطرح است. هر یک از قائلان به ادلهای استناد کردهاند. مقاله حاضر درصدد است تا با ماهیت شناسی نکاح، مسئله حق حبس را مورد واکاوی قرار دهد. حق حبس ازجمله حقوقی است که اغلب در معاملات معوض به وجود میآید و در نکاح نیز دلالت بر معامله بودن دارد و علت ایجاد آن تضمین دریافت مهریه از جانب زوجه است. این نوشتار در پایان به این نتیجه میرسد که با آنجایی که اقتضای عقود معاوضی در عقد نکاح وجود دارد، هر یک از متعاوضین حق دارند تا گرفتن معوض از طرف مقابل نسبت به تسلیم عوض خودداری کنند، اما این مسئله هیچگونه منافاتی با جنبه معنوی نکاح ندارد و نباید تدابیر اتخاذ شده در مباحث فقهی و حقوقی که امکان جبران ضرر و خسارتهای مهلک در اختلافات زوجین را ممکن میکند، با مسائل مذکور آمیخته نمود؛ بنابراین، با توجه به معاملهای بودن عقد نکاح و عوض بودن مهریه و همچنین عوض بودن تمکین در قبال آن، جواز حق حبس به اثبات میرسد.
One of the controversial issues in marriage is that it is transactional. According to different opinions, there are two theories regarding marriage; Some people believe that it is exchangeable and others believe that it is non-exchangeable. Of course, in the meantime, the hypothesis of its quasi-exchangeable is also raised. Each parties have cited some arguments; The present article seeks to explore the issue of the right of lien through the nature of marriage. This article concludes that while there is a requirement for exchangeable transaction in the marriage contract, each of the parties has the right to refuse to submit the exchange until the other part has performed their main contractual obligation, but this does not conflict with the devotional aspect of the marriage. And the measures taken in jurisprudential and legal issues that make it possible to compensate for fatal damages in marital disputes should not be confused with the mentioned issues. Therefore, due to the fact that the marriage contract is transactional and the dowry is exchangeable, as well as the obedience to it is exchanged, the right to lien is proved.
