Abstract:
کفائت درنکاح دارای معنای واحدی درعلم فقه نیست، بلکه درهر یک از مباحث باب نکاح از معنایی خاص برخورداراست که با معنای آن درسایر مباحث متفاوت است. طبق هر معنا صفات و ویژگیهایی در آن معتبر می شوند که طبق معانی دیگر در آن معتبر نیستند. در این مبحث خواهیم دید که از دیدگاه مذاهب مختلف چه ملاکهایی در کفائت اعتبار دارند و رعایت یا عدم رعایت کفائت درنکاح چه آثاری را به دنبال خواهد داشت. همچنین مواضع فقهای شیعه را درباره نظرهای آنان در این زمینه بیان می کنیم. در این بخش از مقاله به چند نکته مهم اشاره می شود: یکی اینکه برخی از فقهای شیعه و سنی در مورد مسئله کفائت، نسبتهایی را به یکدیگر می دهند که با واقعیّت امر منطبق نیست. دیگر اینکه فقهای شیعه قائل اند اکثر اموری که اهل سنت در کفائت معتبر می دانند، در کفائت اعتباری ندارند و شمار بسیاری از بزرگان اهل سنت نیز در این زمینه با شیعه موافق اند. فقهای امامیه بعد از آنکه دلایل مورداستناد اهل سنت را ضعیف اعلام می کنند، با استناد به آیات و روایات، قول خود را با اثبات می رسانند. نکته دیگر نیز این است که از نظر شیعه، معتبر دانستن کفائت در نکاح به شکلی که اکثر اهل سنت می گویند، ریشه در آداب و رسوم دوران جاهلیت دارد و اسلام نیز نه تنها این آداب و رسوم را تایید نکرده، بلکه به مبارزه با آنها برخاسته است. احادیث بسیاری که خود اهل سنت نیز نقل می کنند، این امر راتایید می کند.
Adequacy in marriage does not have a single meaning in the science of jurisprudence, but in each of the topics of marriage has a special meaning that is different from its meaning in other topics. In this article, we will see from the point of view of different religions what criteria are valid in adequacy and what are the effects of observing or not observing adequacy in marriage. We also express the positions of Shiite jurists on their views in this regard. In this part of the article, several important points are pointed out: One is that some Shiite and Sunni jurists on the issue of adequacy, give relations to each other that do not correspond to the reality of the matter. Another is that Shiite jurists believe that most of the things that the Sunnis consider valid in sufficiency are not valid in sufficiency, and many Sunni elders agree with the Shiites in this regard. Imami jurists, after declaring the reasons cited by the Sunnis as weak, prove their promise by quoting verses and hadiths. Another point is that from the Shiite point of view, the validity of adequacy in marriage, as most Sunnis say, is rooted in the customs of the pre-Islamic era, and Islam not only did not approve of these customs, but also fought against them. Has arisen. Many hadiths narrated by the Sunnis themselves confirm this.
