Abstract:
در فقه شیعه، مبحث پوشش برای محارم نیز در کنار نامحرمان مطرح شده و نظراتی میان فقها در این زمینه به وجود آمده است. حد پوشش در منابع فقه شیعه به حدالعوره یاد شده است که به نقاطی از بدن انسان گویند که پوشش آن در برابر نامحرم و نیز محارم ضروری است. برای تشخیص میزان وجوب حد پوشش محارم، بررسی ادله فقها ضروری به نظر میرسد. هدف از بررسی و کندوکاو اقوال و ادله فقهای شیعه در باب حد عورت، واکاوی علمی یکی از احکام مبتلابه میباشد. سؤال اساسی پژوهش این است که «اصل و اساس تعیین حد پوشش برای محارم در فقه شیعه بر چیست؟». این مقاله که به روش اسنادی ـ تحلیلی نگاشته شده، در پی بررسی دیدگاههای فقهای شیعه درباره حد پوشش محارم است. نتیجۀ بحث مؤید این مطلب است که دیدگاه مشهور مبنی بر جواز نگاه به همۀ بدن محارم به جز عورتین، بر اساس ملازمۀ بین نگاه و رعایت پوشش، شکل گرفته است و اعتقاد به پوشش بیش از عورتین، از باب احتیاط میباشد. تأثیر بررسی این دیدگاهها، علاوه بر شناخت احکام فقهی در میان محارم، به رعایت مسائل اخلاقی و تربیتی نیز کمک شایانی میکند.
In Shiite fiqh, the matter of wearing hijab before Maharem (it is an Islamic term meaning “those who are not allowed to marry”) has been propounded alongside non-maharem (a person with whom it is lawful for a Muslim woman to marry) and there are attitudes among Islamic jurists. The boundary of covering in Shiite fiqh sources have been mentioned as the boundary of 'awrah (Arabic: عوره) which parts of the body that are obligatory to be covered before non-maharem and also maharem. For the realization of the measure of the boundary of covering before maharem it is necessary to study the evidences of fuqaha (Islamic jurists and experts). The aim of examining and studying the opinions and evidences of Shi'a jurists about the boundary of 'awrah is to review scientifically one of verdict which is involved with. The basic question is what the principle and base of determining the boundary of 'awrah (Arabic: عوره) is. This paper which has been written in documentary-analytic method is going to study the opinions and views of Shi'a jurists about the boundary of 'awrah. The result has proved that the well-known opinion of Shi'a jurists states that it is lawful or permitted to watch all body of maharem except 'awratain (intimate parts). It is formed based on the correlation between watching and the consideration of covering and belief in covering more than 'awratain is because of Ihtiyaat (Arabic: احتیاط precaution, taking precautionary measures). Besides the knowledge of the jurisprudential verdict between maharem The effect of studying these opinions helps largely to observe the moral and training issues, too.
