Abstract:
زمینه و هدف: ماهیت و مصادیق انفال و نقل و انتقال آن از موضوعات مهمی است که همواره محل بحث بوده است. در این مقاله تلاش شده است بررسی نقل و انتقال و ماهیت انفال در فقه و حقوق ایران بررسی شود. مواد و روشها: مقاله حاضر توصیفی-تحلیلی است و در آن از روش کتابخانهای استفاده شده است. ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانتداری رعایت شده است. یافتهها: یافتهها بر این امر دلالت دارد که در فقه امامیه موهبتهای طبیعی مانند زمینهای موات و جنگلها از موارد انفال دانسته شده است. انفال یا ثروتهای خدادادی از ثروتهای عمومی جامعة اسلامی هستند که ملک خصوصی احدی از مردم نیست و مالک خاصی ندارد. از روایات متعدد بهدست میآید که در زمان حضور پیامبر(ص) انفال از آن پیامبر و امامان معصوم(ع) بوده است و آنان آن را در هر جا که مصلحت میدانستهاند، مصرف میکردهاند. انفال ملک مقام امامت و رهبری پیامبر و امام(ع) است؛ نه ملک شخصی آنان و از اینرو در اختیار ایشان قرار میگیرد که هدایت و زعامت امت را به عهده دارند. نتیجهگیری: از منظر فقه و حقوق، بیع انفال ممنوع است و صرفاً از سوی حکومت اسلامی ممکن است تحت شرایط امکان واگذاری بهصورت موقت و قطعی در قالب فرایندهایی چون خصوصیسازی فراهم شود. بدین معنی که ابتدا مصادیق مختلف انفال در قالب اموال دولتی و مطابق موازین موجود تعریف و سپس در قالب خصوصیسازی به اشخاص خصوصی واگذار شود.
Cont ext and purpose: In this paper, an attempt has been made to investigate the transfer and nature of Anfal in Iranian jurisprudence and law. Materials and methods: This paper is descriptive and analytical and library method is used. Ethical considerations: In this paper, the originality of the texts, honesty and trustworthiness are observed. Findings: The findings indicate that in Imamiyyah jurisprudence, natural gifts, such as fertile lands and forests are considered as Anfal. Anfal or God-given wealth is one of the public wealth of the Islamic society, which is not the private property of any one of the people and has no specific owner. It is obtained from numerous narrations that during the presence of the Prophet (PBUH), Anfal belonged to the Prophet and the Infallible Imams (PBUH) and they used it wherever they thought it expedient. Anfal is the position of Imamat and leadership of the Prophet and Imam (AS), not their personal property, and therefore it is given to them, who are responsible for the guidance and leadership of the Ummah. Conclusion: The sale of Anfal is prohibited and only by the Islamic government, it may be provided under the conditions of temporary and definitive transfer in the form of processes, such as privatization. This means that first the various examples of Anfal are defined in the form of government property and according to the existing standards, then it should be handed over to private individuals in the form of privatization.
