Abstract:
اصل علنی بودن دادرسی یکی از معیارهای احراز عادلانه بودن دادرسی است که منتج به تضمین حقوق اشخاص و ارتقای کیفیت رسیدگی کیفری میگردد، این اصل بهعنوان یک اصل مقبول در اسناد بینالمللی حقوق بشری و اساسنامه دادگاههای کیفری پذیرفته شده است، ولی آنچه مسلم است، اینکه اصل علنی بودن دادرسی، همانند دیگر اصول کلی، اصل مطلقی نیست که تحت هر شرایطی اجرا گردد؛ گاهی عروض مصالحی والاتر نظیر مصالح ملی، اخلاق حسنه، مصالح خصوصی اصحاب دعوا و اقتضای عدالت لزوم رعایت علنی بودن رسیدگی را با محدودیت مواجه میسازد و سببی برای برگزاری غیرعلنی رسیدگیها خواهد شد. این اصل همگام با نظامات حقوقی دنیا در قوانین داخلی پیشبینی شده است و قانون اساسی در اصول ۱۶۵ و ۱۶۸ وسایر قوانین شکلی موضوعه آن را مطمح نظر قرار دادهاند، بیان کلی و غیرشفاف استثنائات این اصل در قوانین بینالملل و ایران، قابل دفاع نیست، و بهکارگیری عباراتی نظیر اعمال منافی عفت»، «جرایم برخلاف حسنه»، «احساسات مذهبی»، «نظم عمومی»، «دعاوی خصوصی و روابط خانوادگی» و... در قوانین داخلی مبهم و غیر شفاف است، و لازم بود تا مقنن این استثنائات را کاملا تبین مینمود تا صرفاً در مواردی که حقاً داخل در استثناست، جلسات رسیدگی به نحو غیرعلنی برگزار گردد، تا از این بستر دادرسی عادلانه تحقق پیدا کند. این جستار که به روش توصیفی- تحلیلی صورتگرفته نخست به جایگاه این اصل در اسناد بینالمللی و داخلی پرداخته و بعد از آن استثنائات وارده بر اصل را مورد دقت نظر قرار داده است.

This essay, which was carried out in a descriptive-analytical method, first discussed the position of this principle in international and domestic documents, and then carefully considered the exceptions to the principle. Considering the dignity and prominent position of the principle of openness, it should be said that the openness of criminal proceedings is considered a principle and non-publicity is considered an exception, which means that the exceptions in practice should be interpreted in a narrow way so as to be the basis for the implementation of this principle. be provided This principle is fully compatible with the standards of human rights and the theoretical basis of this principle is the right of the accused and the interest of the society. Also, Islamic standards are not against this unquestionable principle of law, and examining the statements of the jurists shows that they had public proceedings in their minds as an assumption. Despite the fact that the publicness of the court's verdict has received serious attention in international human rights documents, it is not mentioned in the constitution, and what has been stated in the criminal proceedings regarding the announcement of the verdict of some crimes is not in line with the international regulations.

همان طور که گفته شد اصل علنی بودن در اساسنامه این دادگاه ها ذکر شده است ، ولی در این جستار به حسب اهمیت ، فقط اساسنامه های ICTY،ICTR و ICC، مورد بررسی قرار میگیرد: الف : اساسنامه دادگاه کیفری بین المللی برای یوگسلاوی سابق ( ICTY) بند ۲ ماده ۲۱ اساسنامه ICTY مقرر میدارد، «رسیدگیها باید به صورت علنی باشد مگر این که رئیس دادگاه تصمیم بگیرد که رسیدگیها بر اساس قواعد آئین دادرسی و ادله ، غیرعلنی برگزار گردد».
