Abstract:
عمده فجایع، جرایم و تخلفات مهندسی قابل پیشبینی و پیشگیری هستند و مطابق قانون اساسی پیشگیری از وقوع آنها هم یک وظیفه حاکمیتی است. تجربیات و تحقیقات پیشین داخلی و بینالمللی مبین این واقعیت است که، با اتخاذ سیاستهای صحیح میتوان از یروز بسیاری از تخلفات و جرایم در صنعت ساخت جلوگیری نماید. این تحقیق بر مبنای روش توصیفی-تحلیلی، ابتداً با کنکاش در ادبیات موجود به چرایی وقوع جرایم و تخلفات خاص مهندسی و آثار آن از منظر جامعهشناسیجنایی میپردازد و سپس پیشنهاداتی کاربردی و پیشگیرانه با توجه به تجارب سایر کشورها برای مقابله با این نوع رفتارها ارائه مینماید. عواملی نظیر فرآیند ناصحیح پرورش مهندسان، باور به صحت و عقلانیت رفتار مجرمانه یا متخلفانه و به ویژه پایبندی به اهداف و تلاش برای بقای گروه مهندسی و عوامل اقتصادی در کنار سیاستهای اشتباه دولتی از مهمترین عوامل جرمزا در عرصه مهندسی هستند.برای جلوگیری از بروز انحرافات مهندسی در معنای عام خود، اولاً، با توجه به عدم توازن بازار عرضه و تقاضا در دنیای مهندسی قوانین باید بهگونهای تدوین گردند تا جامعه مهندسی از حمایتهای عادلانه قانونی برخوردار باشند و مجبور نباشد برای نیل به اهداف خود به ابزارهای غیرقانونی متوسل شوند. ثانیاً، مهندسان نباید به عنوان نیروی کار ارزان بر اساس جبر اقتصادی حاکم بر جامعه مطرح باشند و برای فعالیتهای آنان متناسب با شرایط کاری و شاخصههای فنی و خصیصههای فردی و شأن مهندسی حداقل دستمزدی عادلانه تعیین گردد، که عدول از آن برای صاحب سرمایه و قدرت امکان پذیر نباشد. ثالثاً، آموزش مستمر و فرهنگسازی باید در اولویت سیاستهای پیشگیرانه مهندسی باشد. رابعاً، دولت به عنوان صاحب قدرت نباید بیشتر منافع را تنها برای خود قرار دهد و در قراردادهای عمرانی میبایست تعادل عوضین قراردادی رعایت گردد.
Most engineering disasters are predictable and preventable, therefore, by adopting correct policies, many violations and crimes in the construction industry can be prevented. Based on the descriptive-analytical method, this research, first explores the existing literature to find out why engineering crimes and violations occur from the perspective of criminal sociology, and then it provides practical and preventive suggestions for non-normative behaviors in the engineering world. Various researches in the field of domestic and international engineering show that the construction industry has tremendous potential for committing crimes and obtaining illegal financial profits. This research clearly acknowledges that the working conditions in the construction industry, compared to other professions, are very chaotic and critical, and its deterioration has taken on a wider dimension than in the past. are in a crisis situation, the emergence of criminal or criminal behavior is a natural and predictable reaction.On this basis, engineering activities should be legally supported in some way so that the necessary economic minimums are considered for engineers. Factors such as the incorrect process of training engineers, belief in the correctness and rationality of criminal behaviors, and especially adherence to the goals and efforts for the survival of the engineering group, and economic factors are among the most important crime-causing factors in the field of engineering. By studying the theories of criminal sociology and its teachings, this research has come to the conclusion that in order to prevent the occurrence of engineering deviations, first of all, the laws must be formulated in such a way that the engineering community has fair legal protections. Secondly, engineers should not be considered as cheap labor based on the economic determinism of labor market imbalance in the discussion of service supply and demand. Thirdly, continuous education and culture building should be the priority of engineering policies. Fourthly, the government, as the owner of power, should not keep all the benefits for itself, and in construction contracts, the balance of contractual exchange should be observed. The results of this study showed that, Primary and primary prevention should be included in crime prevention policies for engineers. This means that efforts should be made so that engineers do not tend to commit crimes, especially after graduation and in the work environment. The first goal in this method of prevention is to improve the living conditions of engineers in order to prevent them from becoming criminals, and the other goal is to produce and promote values that provide or improve healthy intra-group and out-group relationships in interaction with society.

منطبق با این مبنای فکری، عوامل جرم زا قابل رفع ، دفع و یا تعدیل هستند و میتوان با اتخاذ سیاست های بازدارنده و به ویژه اصول پیشگیری اجتماعی و وضعی چه به صورت عام و چه به شکلی خاص بسیاری از انحرافات فعلی در جامعه مهندسی را کنترل یا به نحوی تقلیل داده یا از میان برد.
در این تحقیق سعی شده است با توجه به علل بروز انحرافات (اعم از جرم یا تخلف و نه موضوعات اخلاقی) در صنعت ساخت ، سیاست های پیشگیرانه مناسب پیشنهاد گردد.
باید اعتراف نمود در زمان حال ، تخلفات ساختمانی و مهندسی به حدی گسترده شده است که اقدامات پیشگیرانه برای رسیدن به آرمان های صنعت ساختی ایدئآل پاسخگوی مشکلات موجود نیست و باید تمهیداتی در جهت التیام بدنه بیمار ساخت و سازهای شهری و برون شهری در نظر گرفته شود.
