چکیده:
در اکثر کتب حقوقی مسئولیتها به تقسیمات مسئولیت اخلاقی، قانونی، قراردادی و قهری، مـدنی و کیفـری تقسـیم شـده است. لزوم جبران ضررهای وارد شده به یک شخص را «مسئولیت مدنی» میگویند. این مسئولیت که اصولا بر عهـده فاعـل زیان و بر مبنای تقصیر است گاه به معنی عام و در جایی به کار میرود که شخصی در برابر دیگری به سبب قانون شـکنی و پیمان شکنی و خساراتی که به او وارد کرده است پاسخگو قرار میگیرد. بعبارت دیگر مسئولیت مدنی ضمانت اجـرای نقـض قانون و تعهد است که بر عهده فاعل زیان قرار میگیرد. یکی از مباحث مرتبط به قاعدة احسان در این حوزه، مسئلۀ «مبنای احکام» اداره و نگهداری بدون اجازة اموال دیگران است. برای ایجاد مسئولیت مدنی و ضمان قهری اسـباب و عـواملی وجـود دارد که در فقه از آنها به موجبات ضمان قهری یاد میشود همچنین برای جلوگیری از ایجاد مسئولیت مدنی و سقوط ضمان قهری برای کسی که شرایط ضمان فراهم شده باشد اسباب وموردها ی وجود دارد که از آنها به مسقطات ضمان قهری تعبیر می گردد یکی از مسقطات ضمان قهری احسان میباشد، بدین معنا که هرگاه کسی به انگیزه خدمت و احسـان بـه دیگـران موجب ورود ضرر به آنها شود عمل او تعهد آور نیست.
In most legal books, responsibilities are divided into moral, legal, contractual and coercive,
civil and criminal responsibility divisions. The need to compensate for the losses caused to a
person is called "civil responsibility". This responsibility, which is basically the
responsibility of the person responsible for the damage and based on fault, is sometimes
used in a general sense and where a person is held accountable to another person for
breaking the law and breaking the contract and for the damages he has caused to him. In
other words, civil liability is the guarantee of the implementation of the violation of the law
and the obligation that is borne by the person responsible for the loss. One of the topics
related to the Ehsan rule in this area is the issue of "the basis of rulings" on managing and
maintaining other people's property without permission. There are reasons and factors for
creating civil liability and compulsory guarantee, which are mentioned in jurisprudence as
the causes of compulsory guarantee. Also, there are reasons and factors to prevent the
creation of civil liability and the fall of compulsory guarantee for those who have provided
the guarantee conditions. They are interpreted as the muscats of compulsory guarantee. One
of the muscats of compulsory guarantee is benevolence, meaning that whenever someone
causes harm to others with the motive of serving and benevolence, his action is not binding.
