Abstract:
تحول در حوزه حقوق بین الملل خصوصی با اراده دولتها در ایجاد رویه ای واحد برای تعیین قانون حاکم بر قراردادها و مسئولیت مدنی بیشتر ظاهر شده است. اما با وجود برخورداری حوزه قراردادها و مسئولیت مدنی از رویه ای واحد در عرصه بین الملل، هنوز مشکلاتی در حل تعارض قوانین، خصوصا در شرایط بروز نقض قوانین همزمان در چند کشور، وجود دارد. در حقیقت قواعد سنتی حل تعارض، بر مکانیزم هایی ثابت و استوار است که در قوانین حاکم بر قراردادها و مسئولیت مدنی کارایی ندارد، زیرا عناصر تشکیل دهنده قراردادها و مسئولیت مدنی از ماهیت متغیر برخوردارند. از این رو شاید بتوان با نگاهی به تئوری تحلیل منافع حاکمیتی (عمومی)، کاستی در قواعد سنتی حل تعارض را جبران نمود. این مقاله، در پی دستیابی به یک قاعده حل تعارض، قابلیت اعمال تئوری یاد شده را در حوزه تعارض قوانین حاکم بر مسئولیت مدنی و قراردادها را بررسی و تبیین می کند.
The change has been further emerged in the field of private international law by the willingness of governments to create a unified procedure for establishing the law governing contracts and civil liability. Despite the scope of contracts and civil liability in the international arena, there are still problems in resolving the conflict of laws, especially in the context of breaches in several countries. In fact, traditional conflict resolution rules are based on fixed mechanisms that do not work in laws governing contracts and civil liability because the constituent elements of contracts and civil liability have a variable nature. Thus, it may be possible to compensate for the deficiencies in traditional conflict resolution rules by looking at the theory of (general) interest analysis. This paper examines and explains the applicability of the aforementioned theory in the area of conflict of laws governing civil liability and contracts, following a conflict resolution rule.
