Abstract:
قانون اساسی به عنوان سندی که آرزوهای جامعه را در خود جای داده در مرحله عمل و اجرا همیشه با مشکلاتی روبرست. هرچند بخشی از اصول قانون اساسی مانند تشکیل ارکان حکومتی به طور معمول اجرائی شده و محقق می شوند، لیکن بخش مهمی از اصول قانون اساسی بدون حمایت دادگاه ها و محاکم قابلیت اجرائی ندارد، هدایت و ترغیب محاکم به توجه بیشتر به اصول قانون اساسی در رسیدگی های خود و استناد به این اصول، راه را برای اجرایی شدن بهتر قانون اساسی فراهم می نماید. در مطالعه رویه محاکم دو کشور مشخص گردید که در محاکم کیفری و حقوقی آمریکا، استناد به اصول قانون اساسی امری رایج است، در حالیکه در ایران استناد به اصول قانون اساسی در محاکم کیفری و حقوقی امری استثنائی و مربوط به چند اصل محدود است، در حالیکه اصول بیشتری از قانون اساسی قابلیت استناد در آرای محاکم را دارا هستند. استناد به اصول قانون اساسی در آرای دیوان عدالت اداری ،علی رغم ایرادات وارده قابل توجه است. استناد به اصول قانون اساسی در آرای محاکم آمریکا برای بی اثر کردن قوانین عادی مغایر با قانون اساسی است در حالیکه نظام حقوقی ایران فاقد چنین ظرفیتی است و در چنین شرایطی استناد به اصول قانون اساسی در ایران در دو وضعیت می تواند منشأ اثر باشد. یکی در جائی که حکم قانون عادی وجود ندارد و دوم این که استناد به قانون اساسی، جنبه تکمیلی و تأکیدی در کنار استناد به قانون عادی به خود بگیرد زیبنده این قانون نمی باشد.
Guiding and persuading the courts to pay more attention to the principles of the constitution in their proceedings and invoking these principles, provides the way for better implementation of the constitution. The citation of constitutional principles in the rulings of the Administrative Court of Justice is significant, despite the objections contained in the method of citation. citation to the principles of the constitution in US courts to invalidate ordinary laws is unconstitutional, and the Iranian legal system lacks such capacity, and in such circumstances citation to the principles of the constitution in Iran in two situations can be a source of effect. One where there is no provision of ordinary law and the second is that citing the constitution has a complementary and emphatic aspect along with citing ordinary law.
