چکیده:
سلاح در لغت به معنی آلت جنگ و هر آلتی است که در جنگ به کار برود. (عمید، ١٣٧٤، ص ٧٤٧) بنابراین از نظر لغوی هر نوع آلت اعم از اسلحه سرد یا گرم که در جنگ و درگیری به کار میرود، در معنای سلاح استعمال شده است. در متون تاریخی، سلاح در معنای ابتدایی آن شامل شمشیر، سپر، تیر و کمان، نیزه و فلاخ نبود. برخی از سلاح های به کار گرفته شده در دوران قدیم عبارت بودند از: زوربین (مرزاق) نیزک (سمنان)، کمان (قوس)، پیکان (نصل)، دشنه (خنجر)، کارد (سکین) و تازیانه (سوط). (اشراق، ١٣٦٠، ص ٣٠٧) در اصطلاح حقوقی، سلاح عبارت است از آلات و ادوات جنگی برنده، سوراخ کنند یا له کننده؛ (جوکار، ١٣٨٩، ص ٣٦) سلاح از لحاظ لغوی بر دو قسم است: ١-سلاح بالطبع مانند تفنگ، شمشیر و مانند اینها، که هدف اول از ساختن آنها، این است که در نظر عرف به عنوان اسلحه به کار رود؛ ٢-سلاح بالقصد، مانند تیغ ژیلت، چکش یا تکه آهنی که انسان آن را در مواردی به طور استثناء به جای سلاح معمولی و متعارف به کار میبرد، با این که عرفا برای کاربرد سلاح اختصاص داده نشده است. مقنن در شهریور سال ١٣٩٠ با نسخ قانون تشدید مجازات قاچاق اسلحه و مهمات مصوب ١٣٥٠و تصویب «قانون مجازات قاچاق اسلحه و مهمات و دارندگان سلاح و مهمات غیر مجاز» مصادیق دیگری از سلاح را تعیین نمود. مطابق ماده ٢ «قانون مجازات قاچاق اسلحه و مهمات و دارندگان سلاح و مهمات غیر مجاز» مصوب ١٣٩٠، «مقصود از سلاح و مهمات در این قانون انواع سلاح های گرم و سرد جنگی و شکاری اعم از گلوله زنی و غیرگلوله زنی و مهمات مربوط به آنها است.» تبصره این ماده نیز مقرر می دارد: «اسلحه لیزری و آن دسته از شبه سلاح هایی که به دلیل مشابهت و کاربرد، قابلیت جایگزینی سلاح را دارند از حیث احکام مندرج در این قانون، حسب مورد تابع احکام سلاح گرم قرار میگیرند و سلاح های آموزشی و بیهوش کننده تابع احکام سلاح شکاری میباشند.» در حال حاضر در حقوق ایران دو موضع در باب سلاح اتخاذ شده است.
